Policy On Agency

Seller's or Buyer's Agency or Disclosed Limited Agency for  In-House Sales

Brown Realty will act as agent of the seller or agent of the buyer or as disclosed limited agent when selling a company listing. Sellers will be usually treated as customers when such seller's property is listed with another brokerage company.

As a listing broker, Brown Realty will cooperate with and split all commissions with a cooperating broker acting as a buyer's agent.

As a buyer's agent, Brown Realty will obtain its compensation from the transaction pursuant to the terms of the buyer broker contract.

Limited Agency Considerations in Implementing This Policy

When obtaining a listing and taking on a buyer client, Brown Realty becomes a limited agency. Each party will be advised accordingly should a potential limited agency situation arise.

Brown Realty will inform the buyer and seller that any terms or information which they deem to be confidential will remain confidential if the parties so desire and will be contained in the written limited agency disclosure addendum.

INFORM THE BUYER AND SELLER THAT BROWN REALTY:

Will not disclose to the buyer the lowest price the seller will take for the property.

Will not disclose to the seller the highest price the buyer will pay for the property.

Will not disclose any other information, which would harm either party's bargaining position.

Will not disclose what motivates the buyer to buy or the seller to sell.

Brown Realty may provide comparable property information, listed and sold properties, which is available through the MLS to both the buyer and seller as a means of assisting both parties in their negotiations.

Brown Realty needs the written consent from the buyers and sellers to the terms of the disclosed limited agency brokerage relationships on some form of limited agency disclosure addendum.
